  • At PTS we offer a comprehensive range of services, although we have worked for acquiring authorities we primarily act for claimants.
  • Compensation is a field in which the acquiring authority will seek to minimise their burden of compensation, within the framework of the law, whilst claimants seek to maximise their payments. Few claimants feel they have been dealt with more than “adequately”; it is a field in which experience, knowledge and a pragmatic approach are essential to achieving a fair result.
  • We, at PTS, provide, an initial evaluation of the situation, establishing under what statutory powers the acquiring authority is conducting its affairs. This establishes what their actual powers are, and, more importantly what the claimant’s proper rights are.
  • We then calculate the heads under which compensation may be paid, the expenses and costs that will be paid as a matter of right and the expenses, if any, which the claimant may have to bear.
  • An estimate of compensation payable is made, together with an estimate of the likely levels of any advance payments.
  • A strategy is then evolved to take the matter to fruition which may be, dependant on the scheme be long drawn out.
  • A claim is lodged and negotiations opened.
  • If agreement at acceptable levels cannot be reached a litigation strategy will be costed and devised.
  • If an application to the Lands Tribunal is agreed to be cost effective then all documentation will be produced, recommendations as to specialist legal and other support made and a proof of evidence for an expert witness prepared.
  • Few cases proceed to litigation unless based on particular points of principle but it is sometimes necessary to refer the matter to litigation to obtain a fair and proper level of compensation for a claimant.
